What rights do I have?

  • Information pursuant to Art. 15 DSGVO about the data stored about you in the form of meaningful information about the details of the processing and a copy of your data;
  • Correction pursuant to Art. 16 DSGVO of incorrect or incomplete data stored by us;
  • erasure pursuant to Art. 17 DSGVO of the data stored by us, unless the processing is necessary for the exercise of the right to freedom of expression and information, for compliance with a legal obligation, for reasons of public interest or for the assertion, exercise or defense of legal claims;
  • restriction of processing pursuant to Art. 18 DSGVO, insofar as the accuracy of the data is disputed, the processing is unlawful, we no longer need the data and you object to their erasure because you need them for the assertion, exercise or defense of legal claims or you have objected to the processing pursuant to Art. 21 DSGVO.
  • Data portability pursuant to Art. 20 DSGVO, insofar as you have provided us with personal data within the scope of consent pursuant to Art. 6 (1) a DSGVO or on the basis of a contract pursuant to Art. 6 (1) b DSGVO and these have been processed by us using automated processes. How is my data processed in detail?

In the following, we inform you about the individual processing operations, the scope and purpose of the data processing, the legal basis, the obligation to provide your data and the respective storage period. An automated decision in individual cases, including profiling, does not take place.

Provision of the website

Type and scope of processing

When you call up and use our website, we collect the personal data that your browser automatically transmits to our server. The following information is stored temporarily in a so-called log file:

  • IP address of the requesting computer
  • Date and time of access
  • Name and URL of the retrieved file
  • Website from which the access is made (referrer URL)
  • Browser used and, if applicable, the operating system of your computer, as well as the name of your access provider.

[Our website is not hosted by ourselves, but by a service provider who processes the aforementioned data on our behalf in accordance with Art. 28 DSGVO].

Purpose and legal basis

The processing is carried out to protect our overriding legitimate interest to display our website and ensure security and stability on the basis of Art. 6 para. lit. f DSGVO. The collection of data and storage in log files is mandatory for the operation of the website. There is no right to object to the processing due to the exception under Art. 21 (1) DSGVO. Insofar as the further storage of log files is required by law, the processing is based on Art. 6 (1) lit. c DSGVO. There is no legal or contractual obligation to provide the data, however, calling up our website is technically not possible without providing the data.

Storage period

Unless a more specific storage period has been stated within this privacy policy, your personal data will remain with us until the purpose for processing the data no longer applies. If you assert a legitimate request for deletion or revoke your consent to data processing, your data will be deleted unless we have other legally permissible reasons for storing your personal data (e.g. retention periods under tax or commercial law); in the latter case, the data will be deleted after these reasons no longer apply.

Note on data transfer to the USA

Among other things, tools from companies based in the USA are integrated on our website. If these tools are active, your personal data may be transferred to the US servers of the respective companies. We would like to point out that the USA is not a safe third country in the sense of EU data protection law. US companies are obliged to hand over personal data to security authorities without you as a data subject being able to take legal action against this. It can therefore not be ruled out that US authorities (e.g. intelligence services) process, evaluate and permanently store your data located on US servers for monitoring purposes. We have no influence on these processing activities.

SSL or TLS encryption

For security reasons and to protect the transmission of confidential content, such as orders or requests that you send to us as the site operator, this site uses SSL or TLS encryption. You can recognize an encrypted connection by the fact that the address line of the browser changes from "http://" to "https://" and by the lock symbol in your browser line.

If SSL or TLS encryption is activated, the data you transmit to us cannot be read by third parties.

Encrypted payment transactions on this website

If, after the conclusion of a contract with costs, there is an obligation to transmit your payment data to us (e.g. account number in the case of direct debit authorization), this data is required for payment processing.

Payment transactions via the common means of payment (Visa/MasterCard, direct debit) are made exclusively via an encrypted SSL or TLS connection. You can recognize an encrypted connection by the fact that the address line of the browser changes from "http://" to "https://" and by the lock symbol in your browser line.

With encrypted communication, your payment data that you transmit to us cannot be read by third parties.

2. Hosting and Content Delivery Networks (CDN)

External Hosting

This website is hosted by an external service provider (hoster). The personal data collected on this website is stored on the hoster's servers. This may include IP addresses, contact requests, meta and communication data, contract data, contact data, names, website accesses and other data generated via a website.

The hoster is used for the purpose of fulfilling contracts with our potential and existing customers (Art. 6 para. 1 lit. b DSGVO) and in the interest of a secure, fast and efficient provision of our online offer by a professional provider (Art. 6 para. 1 lit. f DSGVO).

Our hoster will only process your data to the extent necessary to fulfill its service obligations and follow our instructions regarding this data.

We are using the following host:

Mittwald CM Service GmbH & Co. KG
Königsberger Straße 4-6
32339 Espelkamp

Conclusion of a contract on order processing

To ensure data protection-compliant processing, we have concluded an order processing contract with our hoster.

Cookies

Cookies are small text files that are sent by us to the browser of your end device when you visit our website and stored there. As an alternative to the use of cookies, information can also be stored in the local storage of your browser. Some functions of our website cannot be offered without the use of cookies or local storage (technically necessary cookies). Other cookies, on the other hand, enable us to perform various analyses, so that we are able, for example, to recognize the browser you are using when you visit our website again and to transmit various information to us (non-essential cookies). With the help of cookies, we can, among other things, make our website more user-friendly and effective for you, for example by tracking your use of our website and determining your preferred settings (e.g. country and language settings). If third parties process information via cookies, they collect the information directly from your browser. Cookies do not cause any damage to your end device. They cannot execute programs or contain viruses.

We provide information about the respective services for which we use cookies in the individual processing procedures. You can find detailed information about the cookies used in the cookie settings or in the Consent Manager of this website.

Server log files

The provider of the pages automatically collects and stores information in so-called server log files, which your browser automatically transmits to us. These are:

  • browser type and browser version
  • Operating system used
  • referrer URL
  • Host name of the accessing computer
  • Time of the server request
  • IP address
  • This data is not merged with other data sources.

The collection of this data is based on Art. 6 para. 1 lit. f DSGVO. The website operator has a legitimate interest in the technically error-free presentation and optimization of its website - for this purpose, the server log files must be collected.

The processing of your data by using our contact form is carried out for the purpose of communication and processing of your request on the basis of your consent pursuant to Art. 6 para. 1 lit. a DSGVO. If you contact us by e-mail, telephone or fax, your inquiry including all resulting personal data (name, inquiry) will be stored and processed by us for the purpose of processing your request. We do not pass on this data without your consent.

The processing of this data is based on Art. 6 (1) lit. b DSGVO, if your request is related to the performance of a contract or is necessary for the implementation of pre-contractual measures. In all other cases, the processing is based on our legitimate interest in the effective processing of the requests sent to us (Art. 6 (1) (f) DSGVO) or on your consent (Art. 6 (1) (a) DSGVO) if this has been requested.

The data you send to us via contact requests will remain with us until you request us to delete it, revoke your consent to store it, or the purpose for storing the data no longer applies (e.g. after your request has been processed). Mandatory legal provisions - in particular legal retention periods - remain unaffected.

Nature and scope of processing

For the use of certain areas of our website, you have the option to register a user account. There is a contractual obligation to provide your data, as this information is necessary for the identification of your person as well as for the fulfillment of the contract on our part. There is no legal obligation to provide the data. Without the provision of this information, the registration of a user account and thus the conclusion of a contract is not possible. Furthermore, the processing of additional voluntarily provided information for the purpose of providing further (comfort) functions is based on your consent pursuant to Art. 6 para. 1 lit. a DSGVO. By deactivating the functions / By deleting the voluntary information in the user account, you can declare your revocation at any time with effect for the future pursuant to Art. 7 para. 3 DSGVO.

4.Analytics tools and advertising

Google Analytics

Type and scope of processing

We use Google Analytics from Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland, as an analysis service for the statistical evaluation of our online offer. This includes, for example, the number of times our online offer is called up, sub-pages visited and the length of time visitors stay.

Google Analytics uses cookies and other browser technologies to evaluate user behavior and recognize users.

This information is used, among other things, to compile reports on website activity.

Purpose and legal basis

The use of Google Analytics is based on your consent pursuant to Art. 6 para. 1 lit. a. DSGVO and § 25 para. 1 TTDSG. We intend to transfer personal data to third countries outside the European Economic Area, in particular the USA. In cases where no adequacy decision of the European Commission exists (e.g. in the USA), we have agreed with the recipients of the data on other appropriate safeguards within the meaning of Art. 44 et seq. DSGVO. These are - unless otherwise stated - standard contractual clauses of the EU Commission pursuant to Implementing Decision (EU) 2021/914 of June 4, 2021. You can view a copy of these standard contractual clauses at https://eur-lex.europa.eu/legal-content/DE/TXT/HTML/?uri=CELEX:32021D0914&from=DE. In addition, prior to such a third country transfer, we obtain your consent pursuant to Art. 49 (1) sentence 1 lit. a. DSGVO, which you provide via the consent in the Consent Manager (or other forms, registrations, etc.). We would like to point out that in the case of third country transfers, there may be unknown risks in detail (e.g. data processing by security authorities of the third country, the exact scope and consequences of which for you we do not know, over which we have no influence and of which you may not become aware).

Storage period

The specific storage period of the processed data cannot be influenced by us, but is determined by Google Ireland Limited. Further information can be found in the privacy policy for Google Analytics: https://policies.google.com/privacy.

Google Ads

Nature and scope of processing

We have integrated Google Ads on our website. Google Ads is a service provided by Google Ireland Limited to display targeted advertising to users. Google Ads uses cookies and other browser technologies to evaluate user behavior and recognize users. Google Ads collects information about visitor behavior on various websites. This information is used to optimize the relevance of advertising. Furthermore, Google Ads delivers targeted advertising based on behavioral profiles and geographic location. Your IP address and other identifiers such as your user agent are transmitted to the provider. If you are registered with a Google Ireland Limited service, Google Ads can associate the visit with your account. Even if you are not registered with Google Ireland Limited or have not logged in, it is possible that the provider will find out and store your IP address and other identification features.

In this case, your data will be passed on to the operator of Google Ads, Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland.

Purpose and legal basis

The use of Google Ads is based on your consent pursuant to Art. 6 para. 1 lit.

The concrete storage period of the processed data cannot be influenced by us, but is determined by Google Ireland Limited. Further information can be found in the privacy policy for Google Ads: https://policies.google.com/privacy.

Google Conversion-Tracking

This website uses Google Conversion Tracking. The provider is Google Ireland Limited ("Google"), Gordon House, Barrow Street, Dublin 4, Ireland.

With the help of Google conversion tracking, Google and we can recognize whether the user has performed certain actions. For example, we can evaluate which buttons on our website were clicked how often and which products were viewed or purchased particularly frequently. This information is used to create conversion statistics. We learn the total number of users who clicked on our ads and what actions they took. We do not receive any information with which we can personally identify the user. Google itself uses cookies or comparable recognition technologies for identification.

The use of Google conversion tracking is based on Art. 6 (1) lit. f DSGVO. The website operator has a legitimate interest in analyzing user behavior in order to optimize both its website and its advertising. If a corresponding consent has been requested (e.g. consent to store cookies), the processing is based exclusively on Art. 6 (1) lit. a DSGVO; the consent can be revoked at any time.

More information on Google conversion tracking can be found in Google's privacy policy: https://policies.google.com/privacy?hl=de.

Google Conversion-Tracking

Nature and scope of processing

We have integrated components of DoubleClick by Google on our website. DoubleClick is a brand of Google, under which mainly special online marketing solutions are marketed to advertising agencies and publishers. DoubleClick by Google transfers data to the DoubleClick server with each impression as well as with clicks or other activities. Each of these data transfers triggers a cookie request to the browser of the data subject. If the browser accepts this request, DoubleClick sets a cookie in your browser. DoubleClick uses a cookie ID, which is required to process the technical procedure. The cookie ID is needed, for example, to display an advertisement in a browser. DoubleClick can also use the cookie ID to record which advertisements have already been displayed in a browser in order to avoid duplicate placements. Furthermore, the cookie ID enables DoubleClick to record conversions. Conversions are recorded, for example, if a DoubleClick ad was previously displayed to a user and the user subsequently makes a purchase on the advertiser's website using the same Internet browser.

A DoubleClick cookie does not contain any personal data, but may contain additional campaign identifiers. A campaign identifier serves to identify the campaigns with which you have already been in contact on other websites. As part of this service, Google obtains knowledge of data that Google also uses to generate commission statements. Among other things, Google can track that you have clicked on certain links on our website. In this case, your data is passed on to the operator of DoubleClick, Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland. Further information and the applicable privacy policy of DoubleClick by Google can be found at https://policies.google.com/privacy.

Purpose and legal basis

We process your data with the help of the Double-Click cookie for the purpose of optimizing and displaying advertising on the basis of your consent pursuant to Art. 6 Para. 1 lit. a DSGVO and § 25 Para. 1 TTDSG. You give your consent by setting the use of cookies (cookie banner / Consent Manager), with which you can also declare your revocation at any time with effect for the future pursuant to Art. 7 para. 3 DSGVO. The cookie is used, among other things, to place and display user-relevant advertising and to create reports on advertising campaigns or to improve them. Furthermore, the cookie is used to avoid multiple displays of the same advertising. Each time you call up one of the individual pages of our website on which a DoubleClick component has been integrated, your browser is automatically prompted by the respective DoubleClick component to transmit data to Google for the purpose of online advertising and the settlement of commissions. There is no legal or contractual obligation to provide your data. If you do not give us your consent, a visit to our website is possible without restriction, but not all functions may be fully available.

We intend to transfer personal data to third countries outside the European Economic Area, in particular the USA. In cases where no adequacy decision of the European Commission exists (e.g. in the USA), we have agreed with the recipients of the data on other suitable guarantees within the meaning of Art. 44 et seq.

The concrete storage period of the processed data cannot be influenced by us, but is determined by Google Ireland Limited. Further information can be found in the privacy policy for Google DoubleClick: https://policies.google.com/privacy.

Newsletter

Type and scope of processing

If you register on our website to receive our newsletter, we collect your e-mail address [and, if you provide it, your name...] and store this information together with the date of registration and your IP address. Subsequently, you will receive an e-mail in which you must confirm your subscription to the newsletter (double opt-in). If you do not confirm it, it will automatically expire and the data will not be processed for the newsletter mailing.

Purpose and legal basis

We process your data for the purpose of sending the newsletter on the basis of your consent pursuant to Art. 6 para. 1 lit. a DSGVO. By unsubscribing from the newsletter, you can declare your revocation at any time with effect for the future pursuant to Art. 7 (3) DSGVO. There is no legal or contractual obligation to provide your data, but sending the newsletter is not possible without the provision of your data.

Storage period

After successful confirmation, we store your data until you revoke your consent (unsubscribe from the newsletter).

Clever Reach

This website uses CleverReach to send newsletters. The provider is CleverReach GmbH & Co. KG, Mühlenstr. 43, 26180 Rastede. CleverReach is a service with which the newsletter dispatch can be organized and analyzed. The data you enter for the purpose of receiving newsletters (e.g. e-mail address) is stored on CleverReach's servers in Germany or Ireland.

Our newsletters sent with CleverReach allow us to analyze the behavior of newsletter recipients. Among other things, we can analyze how many recipients have opened the newsletter message and how often which link in the newsletter was clicked. With the help of so-called conversion tracking, it can also be analyzed whether a predefined action (e.g. purchase of a product on this website) has taken place after clicking on the link in the newsletter. For more information on data analysis by CleverReach newsletters, please visit: https://www.cleverreach.com/de/funktionen/reporting-und-tracking/.

The data processing is based on your consent (Art. 6 para. 1 lit. a DSGVO). You can revoke this consent at any time by unsubscribing from the newsletter. The legality of the data processing operations already carried out remains unaffected by the revocation.

If you do not want any analysis by CleverReach, you must unsubscribe from the newsletter. For this purpose, we provide a corresponding link in each newsletter message. Furthermore, you can also unsubscribe from the newsletter directly on the website.

The data you provide for the purpose of receiving the newsletter will be stored by us or the newsletter service provider until you unsubscribe from the newsletter and will be deleted from the newsletter distribution list after you unsubscribe. Data that has been stored by us for other purposes remains unaffected by this.

After you have unsubscribed from the newsletter distribution list, your e-mail address may be stored by us or the newsletter service provider in a blacklist to prevent future mailings. The data from the blacklist will only be used for this purpose and will not be merged with other data. This serves both your interest and our interest in complying with legal requirements when sending newsletters (legitimate interest within the meaning of Art. 6 (1) lit. f DSGVO). The storage in the blacklist is not limited in time. You can object to the storage if your interests outweigh our legitimate interest.

For more details, please refer to the data protection provisions of CleverReach at: https://www.cleverreach.com/de/datenschutz/.

Google ReCAPTCHA

We use Google's reCaptcha service to determine whether a human or a computer is making a particular entry on our newsletter form. Google uses the following data to check whether you are a human or a computer: IP address of the terminal device used, the website that you visit with us and on which the captcha is embedded, the date and duration of the visit, the recognition data of the browser and operating system type used, Google account if you are logged in to Google, mouse movements on the reCaptcha areas and tasks that require you to identify images. The legal basis for the described data processing is Art. 6 (1) lit. f of the General Data Protection Regulation. There is a legitimate interest on our side in this data processing to ensure the security of our website and to protect us from automated entries (attacks).

Plugins and Toola

YouTube with enhanced privacy

This website embeds videos from YouTube. The operator of the pages is Google Ireland Limited ("Google"), Gordon House, Barrow Street, Dublin 4, Ireland.

We use YouTube in the extended data protection mode. According to YouTube, this mode means that YouTube does not store any information about visitors to this website before they watch the video. However, the transfer of data to YouTube partners is not necessarily excluded by the extended data protection mode. Thus, YouTube - regardless of whether you watch a video - establishes a connection to the Google DoubleClick network.

As soon as you start a YouTube video on this website, a connection to YouTube's servers is established. This tells the YouTube server which of our pages you have visited. If you are logged into your YouTube account, you enable YouTube to assign your surfing behavior directly to your personal profile. You can prevent this by logging out of your YouTube account.

Furthermore, YouTube can save various cookies on your end device after starting a video or use comparable recognition technologies (e.g. device fingerprinting). In this way, YouTube can obtain information about visitors to this website. This information is used, among other things, to collect video statistics, improve the user experience, and prevent fraud attempts.

If necessary, further data processing operations may be triggered after the start of a YouTube video, over which we have no control.

YouTube is used in the interest of an appealing presentation of our online offers. This represents a legitimate interest within the meaning of Art. 6 para. 1 lit. f DSGVO. If a corresponding consent was requested, the processing is based exclusively on Art. 6 para. 1 lit. a DSGVO; the consent can be revoked at any time.

For more information about data protection at YouTube, please see their privacy policy at: https://policies.google.com/privacy?hl=de.
